Terms of service—prolingo.net

Target Languages GmbH (hereinafter “Target Languages”) provides its customers (hereinafter “Customer”) with the product prolingo.net, which is a platform whose interface can be used to access various resources. It can be used via a web browser or as an app in Microsoft Teams. In the following terms of service, all employees of the Customer as well as third parties who are granted access to the platform and the content by the Customer are referred to as “Users.”
These terms of service provide information about the nature, scope, and purpose of the use of prolingo.net and the associated collection and use of data, in particular personal data, by Target Languages. Personal data is any information that can be used to identify a person and that can be traced back to them, for example, a person’s name, email address, and telephone number.
Target Languages takes the protection of personal data very seriously and always treats it confidentially and in accordance with the applicable legal regulations. Only authorized employees have access to stored data. Employees and service providers are bound to the strictest confidentiality and confirm this by corresponding written agreements.
Use of prolingo.net
It is at the Customer’s discretion to decide which Users can access Customer’s content on prolingo.net and with which rights and permissions. Target Languages manages the access and user rights according to the Customer’s specifications. It is the Customer’s responsibility to instruct all Users to exercise the necessary caution to prevent access by unauthorized users. The Customer or its Users are fully responsible for the use of prolingo.net and are liable for all damages resulting therefrom.
Target Languages reserves the right to make changes to prolingo.net at any time. This includes, but is not limited to, the design, features offered, and third-party content, especially if technical or licensing changes require such.
Access to and use of prolingo.net by the Customer and Users is permitted solely for lawful, legal purposes. It is prohibited to use prolingo.net for illegal or harmful purposes, including, but not limited to, the distribution of viruses or other harmful software. Posting or uploading content with pornographic, violent, or extremist content is also prohibited. Such content may be removed by Target Languages upon discovery without prior consultation. The responsible Users will be blocked immediately.
Data use
Target Languages respects the privacy of Users and is committed to keeping their data safe. The use of data is for a specific purpose only, for example, to provide and use the functions offered.
The following data is collected when using prolingo.net:

The processing of this data is carried out in accordance with Art. 6(1)(1)f of the GDPR. Our legitimate interest is to offer and improve prolingo.net and to ensure the stability and functionality of the platform. The data is collected and stored purely for technical reasons.
prolingo.net is based on Microsoft’s Azure/SharePoint technology. Access to prolingo.net takes place via the User’s Microsoft account and the transfer of data takes place with the most modern TLS encryption. For the processing of data, we therefore refer to the respective current terms of use and data protection provisions of Microsoft for the aforementioned products.
Misuse and inappropriate transfer of data by or to third parties will not take place. Data will only be transferred to state institutions and authorities within the scope of mandatory national or official legal provisions.
Content on prolingo.net
In the course of providing information via prolingo.net, data is stored and processed. These are made available to Users, depending on the configuration of access and reading rights. Some integrated services also require the processing and use of data, including the administration and customization of machine translation.
The contents of the platform can be distinguished according to:
a) Customer-specific content
This includes all content that is stored on a customer-specific basis, for example, stylistic rules, terminology specifications, customer-specific publications and files, and product information.
By providing the content, the Customer confirms that they have the rights to the data and to use such for its intended purpose and to make such available to all Users. As a precaution, the Customer expressly indemnifies Target Languages from any claims by third parties.
b) Non-customer-specific content
Target Languages incorporates content from its own source as well as from third-party providers into prolingo.net and makes it available to Users. These third-party providers currently include:

Additional data sources and third-party providers may be integrated. In order to use the embedded functions and access content, user data may be transferred to the provider, for example, via an API interface. Relevant information that is required for proper access to the services and content of the third-party providers is collected.
If a User accesses the function of an integrated third-party provider, the data protection conditions of the respective third-party provider apply. Please refer to the respective third-party providers’ terms and conditions as currently published for information on how, to what extent, and for how long they store and use Users’ data. Target Languages assumes no liability or responsibility for the privacy policies and use of data by third-party providers.
Machine translation
When using machine translation, the content as well as data of the query are transferred to third-party providers via API commands. Such data is not stored permanently during this process. The translations of documents are only stored temporarily for the execution of the translation.
For the customization (“training”) of the machine, the texts provided by the Customer remain in a protected database (translation memory). The Customer must ensure that they own all rights to the transferred content and that there is no infringement, in particular of personal rights, patents, or trademarks. As a matter of principle, texts containing personal data of any kind may only be translated if there is a justification for this under data protection law.
Each time a User employs machine translation via prolingo.net, the following data is collected in addition to the source and target text:

Error messages during translation
This information is processed in accordance with Art. 6(1)(1)f of the GDPR. The provision and improvement of machine translation represents a legitimate interest. The aforementioned data is stored for a maximum of 14 days and protected against unauthorized access.
The processing of documents (Word, Excel, PowerPoint) uploaded for machine translation via prolingo.net takes place within the European Economic Area. The situation is different for the translation of PDF documents. Their content must be converted to open text for technical reasons. This is done automatically via an API interface provided by Adobe. The conversion back to PDF format after translation also takes place via an API interface provided by Adobe. In the process, data is transferred to Adobe Systems Software Ireland Limited, Ireland, and to Adobe Inc, USA. Adobe stores the files received on its own servers for a maximum of 24 hours. There are agreements with Adobe for commissioned processing, which include so-called EU standard contractual clauses in accordance with Art. 46(2)c of the GDPR. By uploading a PDF document, the User instructs Target Languages to use the API interfaces to Adobe and gives his consent to the described processing and storage of the file. At the same time, the User confirms that they own all rights to the documents and their contents. The Customer or the User shall be solely liable for possible violations of applicable data protection regulations, particularly personal data.
Concluding remarks
The measures described above do not guarantee that data will not be accessed, disclosed, altered, or destroyed in violation of data protection regulations. By using prolingo.net, the Customer or User confirms that they understand and accept these risks and consent to the storage and use of their data as described in this statement.
Target Languages reserves the right to change all or part of the prolingo.net platform, terms of service, and privacy policy at its sole discretion at any time without notice. Therefore, the User is encouraged to regularly check the Terms of Service available at the time of registration.
Should any of the above provisions be or become invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid provision that comes as close as possible to the economic purpose of the invalid provision.
